Terms of Service

These Terms govern your use of the GoBits app, the optional GoBits Cloud service and this website (together, the "Service"), provided by [Your legal entity] ("GoBits", "we", "us"). By using the Service you agree to these Terms. If you use it for an organization, you confirm you're allowed to accept these Terms on its behalf.

1. Early access

GoBits is in invite-only early access. Features may change, break or be removed, and the Service is provided for evaluation. We may limit, pause or end early access at any time. Invite codes are personal and may not be sold.

2. Accounts

You don't need an account to use the app in guest mode. If you create a GoBits Cloud account, keep your sign-in method secure and tell us promptly about any unauthorized use. You must be at least 16 years old to use the Service.

3. Your AI provider and API keys

GoBits works with AI providers you choose and connect with your own API key. Your use of those providers is governed by their terms, and you are responsible for any fees they charge. Usage and cost figures in GoBits are estimates only, and the daily budget feature is a convenience, not a guarantee.

4. Tools that run on your computer

Bits can read and write files in your workspace, fetch web pages and, with your approval, run commands on your computer. You are responsible for the commands and changes you approve and for keeping backups of important data. Use a dedicated workspace folder and review every request before you allow it. Checkpoints and revert help, but they are not a backup.

5. Your content and AI output

You keep all rights to the orders you write, the files you use and the results your Bits produce. We don't claim ownership of them. AI output can be wrong, incomplete or similar to other people's content. Review it before you rely on it, and don't use it as professional (for example legal, medical or financial) advice. When you create a share link, you're responsible for what you share. You grant us the limited permission needed to host and display shared content until you revoke the link.

6. Acceptable use

Don't use the Service to:

• break the law, or infringe other people's rights;
• attack, scan or overload systems you don't own or have permission to test;
• create malware, spam, or content that sexually exploits minors;
• bypass invite limits, rate limits or security controls, or access other users' data;
• resell or provide GoBits Cloud to third parties without our written permission.

7. Fees

We don't currently charge for early access. If we introduce paid plans, we'll tell you the price in advance, and you won't be charged unless you choose a paid plan.

8. Our property and feedback

The GoBits name, logo, pixel art, software and website belong to us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to use the Service. If you send us feedback, we may use it without any obligation to you.

9. Suspension and termination

You can stop using the Service and delete your cloud account at any time. We may suspend or end your access if you breach these Terms or if we need to protect the Service or other users. Sections that by their nature should survive will survive termination.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of AI output, and non-infringement, to the extent permitted by law.

11. Limitation of liability

To the extent permitted by law, GoBits won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, including loss caused by commands or changes you approved. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that can't be limited by law, or your rights as a consumer.

12. Changes

We may update these Terms. If a change is material, we'll give reasonable notice by email or in the app. If you keep using the Service after a change takes effect, you accept the new Terms.

13. Governing law

These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-law rules. Mandatory consumer protection laws of your country of residence still apply.
